These Terms and Conditions ("Terms") are a legally binding agreement between you and ARTIFACTS LLP

("ARTIFACTS", "we", "us", or "our") governing the Pageling mobile applications, Pageling web pages that link to

these Terms, and related features and services (together, "Pageling").


Key Points


- Pageling gives you a personal licence to use the app; it does not transfer ownership of the software or ARTIFACTS brand.

- You keep ownership of your own highlights, notes, scans, and other content. You give us only the limited

permission needed to operate the features you choose.

- You are responsible for having permission to scan, import, save, and use material from books, articles, or

third-party accounts.

- OCR, catalogue data, recommendations, and AI-assisted Smart Scan can be incomplete or wrong. Review

important output before relying on it.

- Paid plans, renewal terms, trials, and prices must be shown before purchase. Apple or Google normally handles

billing, cancellation, and refunds.

- Pageling is intended for users aged 18 or older while it includes the current Google Gemini Smart Scan service.

- Mandatory consumer rights and statutory guarantees are not waived by these Terms.

- Pageling is not promised forever. If we must discontinue a material service, we will try to give reasonable notice

and an opportunity to export accessible user content where feasible.


1. About ARTIFACTS and Pageling

Pageling helps users capture, organise, revisit, and learn from reading passages, highlights, notes, books, and

articles. Features may include on-device OCR, optional Smart Scan, cloud sync, reminders, connected imports,

catalogue search, reading activity, and paid entitlements. Availability varies by device, country, app version, and

plan.


2. Acceptance, eligibility, and authority


You accept these Terms by downloading or using Pageling, creating an account, tapping an acceptance control,

buying a Pageling entitlement, or otherwise indicating agreement. If you do not agree, do not use Pageling.

You must be at least 18 years old and legally capable of entering this agreement. Pageling is not directed to, and

must not be used by, anyone under 18. Do not create an account or use Pageling if you do not meet this

requirement.

If you use Pageling for an organisation, you represent that you are authorised to bind that organisation. Consumer

features and app-store purchases are intended primarily for personal use unless a plan expressly states otherwise.


3. Relationship to other terms

The ARTIFACTS company Terms and Conditions also govern company-level websites and communications. These

Pageling Terms control if there is a conflict about Pageling. The Pageling Privacy Policy explains data handling and

forms part of the relationship between us, but it is a notice rather than a transfer of ownership or blanket consent.
Your app store, device platform, sign-in provider, and connected services have separate terms. Their terms govern

their own services. A plan description, promotion, beta agreement, or written business contract may add terms for

that offering; a specifically agreed term controls over these Terms to the extent of a direct conflict.

If you obtain Pageling through Apple App Store, Apple's Standard End User License Agreement supplies the

licence for the Apple-distributed copy unless ARTIFACTS separately provides a compliant custom end-user licence

through App Store Connect. These Terms govern your Pageling account, cloud services, content, features,

purchases, and relationship with ARTIFACTS. A mandatory store term or the Apple Standard End User License

Agreement controls to the extent of a direct conflict about the store or application licence.



4. Licence to use Pageling

Subject to these Terms and any applicable store rules, ARTIFACTS grants you a limited, personal, revocable,

non-exclusive, non-transferable, and non-sublicensable licence to install and use the object-code version of

Pageling on devices you own or control, for its intended lawful purpose and any permitted Family Sharing or

volume-purchase use. For an Apple-distributed copy, the licence terms in Apple's Standard End User License

Agreement control to the extent they apply.

This is a licence, not a sale. ARTIFACTS and its licensors retain all rights not expressly granted. The licence ends

when these Terms or your right to use Pageling ends.

You may not rent, lease, sell, redistribute, sublicense, copy, modify, translate, create a derivative product from,

reverse engineer, decompile, disassemble, extract source code from, or bypass technical restrictions in Pageling

except to the limited extent that applicable law expressly permits despite this restriction. Open-source components remain governed by their applicable licences.

5. Accounts and account security

Some features require an account. You must provide accurate information, maintain control of the sign-in account

and device, and promptly notify us if you suspect unauthorised access. Do not share authentication tokens,

impersonate another person, create deceptive accounts, or use another person's account without permission.

You are responsible for activity reasonably attributable to your account until you notify us of a compromise, except

to the extent the activity resulted from our failure to use legally required care. We may require recent authentication

before sensitive actions such as account deletion, purchase restoration, or changing security information.

6. Your content and ownership

"Your Content" means highlights, passages, notes, tags, scans, photographs, imported reading data, feedback

attachments, and other material you submit to or create in Pageling. As between you and ARTIFACTS, you retain

any ownership rights you have in Your Content. These Terms do not give ARTIFACTS ownership of it.

You grant ARTIFACTS a limited, worldwide, non-exclusive, royalty-free licence to host, reproduce, transmit, format,

cache, back up, and otherwise process Your Content only as reasonably necessary to:

- provide the Pageling feature you select, including sync, import, export, OCR, and optional Smart Scan;

- protect, troubleshoot, and maintain Pageling;

- follow your instructions; or

- comply with law and enforce these Terms.

This licence is not permission to publish Your Content, sell it, train advertising profiles with it, or use it to market

unrelated products. It ends when the relevant content is deleted from active systems, except for temporary backups, de-identified information, and copies that must be retained for a legal or security reason. You represent that you have the rights and permissions needed to provide and use Your Content in this way and that doing so does not unlawfully infringe another person's copyright, privacy, confidentiality, or other rights.

7. Books, articles, copyright, and personal use

Pageling is a tool for personal reading and organisation. It does not grant you a licence to a book, article, website,

image, or provider account. Copyright exceptions differ by country and context. You are responsible for deciding

whether scanning, storing, importing, quoting, exporting, sharing, or otherwise using a work is permitted.

Do not use Pageling to reproduce or distribute substantial copyrighted works without authority, evade digital

restrictions, scrape a service unlawfully, disclose paywalled material, or build an unauthorised commercial archive.

A feature's technical ability to capture or export material does not mean the use is legally permitted.

We may remove or restrict allegedly infringing content and may suspend repeat or serious misuse after appropriate

review. Copyright notices should identify the work, the material or account at issue, the complainant's contact

information, a good-faith explanation, and the complainant's authority, and should be emailed to

contact@artifacts.software with the subject "Pageling copyright notice." We may ask for additional legally

required information and may forward the notice to the affected user.

8. OCR, Smart Scan, catalogue data, and recommendations

8.1 On-device OCR

Standard OCR attempts to recognise printed text from a page image on your device. Lighting, typeface, page

curvature, language, image quality, annotations, and device capability affect accuracy. Review and correct

recognised text before saving, quoting, studying, or relying on it.

8.2 Smart Scan

Smart Scan is an optional AI-assisted feature available only to users aged 18 or older. It may send selected OCR

text, a reduced page image containing surrounding context, selection coordinates, and book title to cloud providers

as described in the Pageling Privacy Policy. You must review the disclosure and choose to continue before using it.

Smart Scan may omit, invent, reorder, or misinterpret words. It is not a certified transcription, accessibility,

translation, educational-assessment, medical, legal, financial, or professional service. Do not rely on it where an

error could affect rights, safety, health, money, or academic integrity without checking the original source and,

where appropriate, a qualified professional.

8.3 Catalogue and recommendation information

Book covers, summaries, editions, identifiers, categories, and recommendations can come from third-party

catalogues or automated matching. They may be incomplete, outdated, duplicated, or wrong and do not represent

an endorsement by ARTIFACTS. Rights in third-party covers and metadata remain with their respective owners or

licensors.

9. Connected services and imports

Pageling may allow you to open or connect to services such as Amazon Kindle or Instapaper and import supported

data at your direction. Those services are independent from ARTIFACTS. You must comply with their terms,

permissions, technical limits, and account rules.

You authorise Pageling to access and process only the connected information needed for the import you request.

ARTIFACTS does not guarantee that an integration will remain available or compatible. A provider may change or

withdraw access, and we may alter or remove an integration if required for security, law, provider compliance, or

technical sustainability.

Do not give ARTIFACTS your third-party password through support. When an embedded provider page is used,

credentials are entered into that provider's page. Session cookies may remain locally on your device as explained in

the Pageling Privacy Policy.

10. Acceptable use

You must not use Pageling to:

- break the law, violate another person's rights, or facilitate fraud, harassment, threats, exploitation, or abuse;

- upload malware, harmful code, illegal content, or content designed to interfere with another system;

- access another user's data or account, probe or defeat security, forge requests, or conceal malicious activity;

- abuse free trials, purchase restoration, quotas, refunds, referrals, or promotions;

- automate requests, scrape, benchmark for a competing service, or impose excessive load beyond documented or ordinary personal use;

- extract models, prompts, private APIs, keys, or non-public datasets;

- use Pageling to develop or train a substantially competing product from non-public Pageling output, except where applicable law expressly permits;

- misrepresent Pageling output as verified source text when it has not been checked; or

- encourage or help another person do any of the above.

Reasonable security research should be reported privately to contact@artifacts.software before disclosure. We

will consider good-faith, proportionate research that avoids privacy harm, disruption, extortion, and data retention.

11. Free features, paid plans, and entitlements

Pageling may offer free features, subscriptions, one-time purchases, usage allowances, trials, promotional access,

or beta entitlements. The checkout screen and plan description will identify the material terms then offered,

including included features, price, billing period, trial period, renewal behaviour, and usage limits. Features and

prices may differ by platform, country, tax, currency, and purchase date.

A paid entitlement is personal to your store and Pageling account unless the offer expressly permits family, team, or

transferable use. Usage allowances, AI credits, or quotas do not have cash value, cannot be resold, and may expire

or reset as disclosed before purchase. We will not quietly convert a one-time entitlement into a recurring

subscription.

We may change future prices or plan contents. A price increase for an existing auto-renewing subscription will

follow the store's notice and consent rules. If a material paid feature is removed during an already-paid fixed term,

we will provide a remedy required by law, which may include continued access, a substitute, a proportionate refund,

or cancellation.

12. Subscriptions, renewal, cancellation, and refunds

If you buy an auto-renewing subscription through Apple App Store or Google Play:

- payment is charged to your store account when the purchase is confirmed;

- the subscription renews automatically at the price and frequency shown at purchase unless you cancel through the

store before its renewal deadline;

- deleting Pageling or your Pageling account does not itself cancel the store subscription;

- you can manage or cancel through your Apple or Google subscription settings;

- a free trial converts to a paid term only as disclosed at checkout; and
- any unused part of a trial or period is handled under applicable law and store rules.

Apple or Google normally determines and processes refunds for store purchases. Contact the store through its

refund process. You may also email support@artifacts.software for purchase-support information, but we cannot

issue a store refund we do not control. Nothing here limits a refund, cooling-off period, statutory guarantee, or other remedy that applicable law requires.

Restore Purchases checks the applicable store and entitlement service; it does not create a new purchase.

Different store accounts or platforms may not share an entitlement unless the plan expressly supports cross-platform access.

13. Taxes and payment issues

Displayed prices may include or exclude tax as stated by the store and local law. You are responsible for valid payment information maintained with the store. A chargeback, revoked transaction, failed renewal, refund, fraud signal, or store decision may remove the related entitlement. We will restore access if reliable records show that a valid entitlement was removed by our error.

14. Privacy and permissions

The Pageling Privacy Policy explains account data, local and cloud storage, OCR, Smart Scan, imports, catalogue

requests, purchases, analytics, diagnostics, notifications, retention, and deletion. Review it before use.

Camera, photo-library, notification, analytics, Smart Scan, and similar permissions are used only for the purpose

described when requested and in the Privacy Policy. You can refuse optional permissions, although the related

feature may not work. Operating systems and connected providers control some permission and account settings

independently.

15. Backups, sync, export, and loss prevention

Cloud sync is a convenience, not a guaranteed archival or backup service. Offline edits, device clocks, account

changes, connection failures, app reinstalls, provider outages, and software defects can cause delay, conflict, or

data loss. Keep an independent copy of irreplaceable notes and passages and review available export tools before

changing devices or deleting an account.

Where an export feature is offered, the export may exclude third-party covers, protected material, internal metadata, or data that we are not legally permitted to provide. We may impose reasonable security checks, technical limits, and formats.

16. Updates, changes, beta features, and availability

We may update Pageling to add or remove features, address security, comply with platform requirements, improve

compatibility, or change providers. Some updates may be required to continue using cloud or purchase features.

Your device and operating system must meet the supported requirements.

Beta, preview, experimental, and early-access features may be incomplete, unstable, changed, rate-limited, or

withdrawn. Do not depend on them for irreplaceable data or critical activity. A beta label does not remove rights that law makes mandatory. Pageling can be interrupted by maintenance, internet and provider outages, emergencies, security events, store action, force majeure, or circumstances beyond reasonable control. We do not promise uninterrupted or error-free availability, but we will use reasonable care in operating paid services.

17. Discontinuation and product shutdown

ARTIFACTS may discontinue Pageling or a feature if it becomes unsafe, unlawful, technically impracticable,

commercially unsustainable, dependent on an unavailable provider, or necessary because of insolvency,

emergency, or another serious circumstance.

When reasonably possible, we will give advance notice proportionate to the impact. If discontinuation affects

accessible cloud-stored user content, we will try to provide a practical period and method to export it. If it materially

prevents delivery during a prepaid term, we will provide the remedy required by law and applicable store rules.

Immediate restriction may be necessary for security, legal orders, platform removal, or prevention of harm.

No term promises that Pageling, cloud sync, Smart Scan, a provider integration, or any free feature will operate

indefinitely.

18. ARTIFACTS intellectual property

Pageling and its software, source code, object code, models and prompts created by ARTIFACTS, interface,

original illustrations, icons, animations, sounds, layouts, documentation, website, product name, ARTIFACTS name,

logos, and other original materials are owned by or licensed to ARTIFACTS and protected by intellectual-property

law.

Except for the limited licence in Section 4, these Terms do not grant a right to use ARTIFACTS or Pageling names,

marks, trade dress, domains, designs, or content. You may make truthful, non-misleading references and fair

reviews as permitted by law.

Third-party books, articles, covers, trademarks, metadata, libraries, and open-source components remain the

property of their respective owners. Their appearance does not imply sponsorship unless expressly stated.

19. Feedback

If you voluntarily send an idea or suggestion about Pageling, you grant ARTIFACTS a perpetual, worldwide,

non-exclusive, royalty-free, transferable, and sublicensable licence to use, adapt, and commercialise that feedback

without an obligation to compensate you. This applies to the idea or suggestion, not to your private library content or personal data. Do not send confidential business information as feedback unless we have first signed a

confidentiality agreement.

20. Suspension, restriction, and termination

You may stop using Pageling at any time. You may delete your account through the in-app control or the method in

the Pageling Privacy Policy. Account deletion does not automatically cancel an app-store subscription.

We may proportionately restrict or suspend an account or feature when reasonably necessary to investigate or

address fraud, security risk, illegal activity, serious or repeated breach, payment reversal, excessive automated use,

harm to another person, or a legal or platform requirement. Where appropriate, we will give notice and an

opportunity to correct the problem or appeal by email. We may act immediately when delay would create material

risk.

We may terminate access for a material breach that is not corrected after notice, or immediately for intentional

illegality, serious security abuse, or conduct likely to cause substantial harm. On termination, the licence ends.

Sections that by their nature should survive - including ownership, payment obligations already incurred, warranty

limitations, liability, disputes, and lawful retention - continue to apply.

21. Disclaimers and consumer guarantees

Pageling is provided using reasonable skill and care. However, to the maximum extent permitted by law, Pageling

and third-party content are provided "as is" and "as available." ARTIFACTS does not promise that every OCR

result, Smart Scan result, recommendation, cover, catalogue record, import, sync operation, reminder, or third-party integration will be accurate, complete, available, or suitable for your particular purpose.

Nothing in these Terms excludes, restricts, or modifies a guarantee, warranty, right, or remedy that applicable

consumer law does not allow us to exclude. If a legally required guarantee applies, our responsibility is limited only

to the extent that the law permits. Statements in an app-store listing or plan page form part of the offer where

applicable law says they do.

22. Limitation of liability

To the maximum extent permitted by law, neither ARTIFACTS nor its partners, personnel, or licensors will be liable

for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, goodwill, opportunity,

or data, arising from Pageling, where such loss was not reasonably foreseeable or was caused by matters outside

reasonable control.

To the maximum extent permitted by law, ARTIFACTS's total aggregate liability arising from Pageling will not

exceed the greater of:

- the amount you paid for Pageling during the 12 months before the event giving rise to the claim; or

- INR 5,000 (or its local-currency equivalent).

The limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of

confidentiality or data-protection duties where liability cannot lawfully be limited, an infringement claim caused by

ARTIFACTS, or any other liability or consumer remedy that applicable law prohibits us from limiting.

23. Your responsibility for third-party claims

To the extent permitted by law, you will be responsible for a third-party claim and reasonable direct costs resulting

from your intentional unlawful use of Pageling, material infringement by Your Content, or deliberate breach of

Sections 7 or 10. This does not require you to compensate ARTIFACTS for our own negligence, unlawful conduct,

product defect, or breach, and it does not reduce any non-waivable consumer right. We will give prompt notice and

allow reasonable participation in the defence; we may not settle a claim in a way that admits fault or imposes a

non-monetary obligation on you without your consent.

24. Additional terms for Apple users

If you obtain Pageling through Apple App Store, Apple's Standard End User License Agreement applies as

described in Section 3 unless ARTIFACTS separately supplies a compliant custom end-user licence in App Store

Connect. These Terms are between you and ARTIFACTS, not Apple. ARTIFACTS, not Apple, is solely responsible

for Pageling and its content, maintenance and support, and product claims, subject to these Terms, the applicable

licence, and applicable law. Apple has no obligation to provide maintenance or support.

If Pageling fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase

price paid for the app, if any, as provided by its rules. To the maximum extent permitted by law, Apple has no other

warranty obligation. ARTIFACTS is responsible for addressing claims relating to Pageling, including product-liability,

legal or regulatory, consumer-protection, and intellectual-property claims.

You represent that you are not located in a country subject to a United States government embargo and are not

listed on a United States government prohibited or restricted-party list. You must comply with applicable third-party terms when using Pageling. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this Section and the licence against you.

25. Additional terms for Google Play users

If you obtain Pageling through Google Play, these Terms are between you and ARTIFACTS, not Google. Google is

not responsible for Pageling, support, content, warranties, or claims, except for responsibilities Google expressly

assumes under its own terms or applicable law. Your use is also subject to the Google Play Terms of Service.

Google and its affiliates are intended third-party beneficiaries only to the extent required by those terms.

26. Export controls and legal compliance

You must use Pageling in compliance with applicable trade, sanctions, export-control, and local laws. You may not

use or export Pageling where prohibited. Nothing in this Section requires you to waive a consumer right or permits

ARTIFACTS to discriminate unlawfully.

27. Governing law and disputes

Before filing a claim, you and ARTIFACTS should try in good faith for 30 days to resolve it by emailing

contact@artifacts.software with a concise description and requested remedy. This informal step does not prevent

either party from seeking urgent relief or using a consumer forum, regulator, small-claims procedure, or other

process where delay would prejudice a right.

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory

consumer law and any forum you are legally entitled to use, courts in Bengaluru, Karnataka have non-exclusive

jurisdiction. You retain the protection of mandatory law in the place where you ordinarily live. These Terms do not

require private arbitration and do not waive a right to participate in a class or representative proceeding where that

right cannot lawfully be waived.

28. Changes to these Terms

We may update these Terms for new features, providers, security, business practices, or law. We will post the

updated version with its effective date. For a material change that adversely affects an existing paid service or legal

right, we will provide reasonable advance notice when required. If consent is legally required, we will ask for it.

Otherwise, continued use after the effective date means the updated Terms govern future use; you may stop using Pageling if you do not accept them.

An update will not retroactively give ARTIFACTS ownership of Your Content, convert a one-time purchase into a

recurring subscription, or remove mandatory consumer rights.

29. General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will stay

effective. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent,

except where law gives you that right. ARTIFACTS may transfer it as part of a genuine merger, reorganisation,

financing, or sale, provided the successor remains bound by applicable obligations.

These Terms, the Pageling Privacy Policy, applicable plan details, and any specifically agreed written terms form

the entire agreement about Pageling. Headings are for convenience. "Including" means "including without limitation." Electronic notices and acceptance may be used where legally valid.
