These Terms and Conditions ("Terms") govern access to artifacts.software, company-level pages,

communications, and other services expressly linked to these Terms (collectively, the "Company Services"). They are a legally binding agreement between you and ARTIFACTS LLP ("ARTIFACTS", "we", "us", or "our").


Key points

- ARTIFACTS owns its software, brands, original designs, website, and product materials, but you retain

ownership of your own content.

- Individual products may have additional product-specific terms. Those terms control for that product if there is a conflict.

- Purchases made through Apple, Google, or another platform are also subject to that platform's billing and refund rules.

- Mandatory consumer rights always remain available.

- We may change or discontinue a service, but we aim to give reasonable notice and a practical export opportunity when user data or a paid term is affected.


1.  About ARTIFACTS


ARTIFACTS LLP is an Indian limited liability partnership that designs, develops, publishes, and supports digital

products, including mobile applications, web applications, websites, desktop software, developer tools,

software-as-a-service products, and related content.

2.  Acceptance and eligibility


By accessing or using a Company Service, creating an account, submitting a form, or otherwise indicating

agreement, you accept these Terms. If you do not agree, do not use the Company Services.


You must be legally capable of entering this agreement. If you are below the age of legal majority, a parent or legal guardian must review and accept these Terms where permitted by law. If you use a Company Service for an organisation, you represent that you are authorised to bind that organisation, and "you" includes it.


3. Relationship to product-specific terms


An ARTIFACTS product may be governed by its own terms, end-user licence agreement, privacy policy, plan

description, order form, or written contract. Those product-specific documents supplement these Terms and take priority for that product if there is a conflict.


Pageling, Momentum, and future ARTIFACTS products may each have different features, risks, permissions,

payment models, and data practices. You should review the documents linked from the relevant product before use.


A custom development, design, consulting, partnership, supplier, or enterprise engagement requires a separate written agreement. Website descriptions, estimates, or informal discussions do not replace that agreement.


4.  Limited permission to use the Company Services


Subject to these Terms, ARTIFACTS grants you a limited, personal, non-exclusive, non-transferable,

non-sublicensable, and revocable permission to access and use the Company Services for their intended lawful purpose.


No ownership right is transferred. Rights not expressly granted are reserved by ARTIFACTS and its licensors.


5. Accounts and security


Where an account is available, you agree to provide accurate information, keep credentials secure, promptly notify us of suspected unauthorised use, and accept responsibility for activity reasonably attributable to your account. You may not impersonate another person, create accounts through deception, or bypass eligibility, payment, quota, or security controls.


We may require re-authentication before a sensitive action. We may also refuse, suspend, or close an account reasonably believed to be compromised, fraudulent, unlawful, or materially in breach of these Terms. Where practical and lawful, we will provide notice and an opportunity to correct the issue.


6.  Acceptable use


You must not:


- use a Company Service unlawfully or to harm, harass, exploit, deceive, or infringe the rights of others;

- upload malware, attack infrastructure, probe for vulnerabilities without written authorisation, or interfere with another user's access;

- bypass access controls, rate limits, payment checks, subscriptions, quotas, or technical restrictions;

- scrape, crawl, index, or extract substantial portions of a service through automated means except as expressly permitted;

- reverse engineer, decompile, disassemble, or attempt to derive source code except to the limited extent applicable law expressly permits despite this restriction;

- copy, sell, rent, sublicense, redistribute, frame, mirror, or commercially exploit a Company Service or its original content without permission;

- use ARTIFACTS products, output, names, or marks to mislead others about origin, approval, affiliation, or

endorsement;

- submit content you do not have the right to use; or

- use a service in a way that creates unreasonable security, legal, operational, or financial risk.


Reasonable interoperability, security research, accessibility, and statutory rights are not restricted where applicable law makes them non-waivable. Contact us before security testing so we can authorise a safe scope.


7. ARTIFACTS intellectual property


ARTIFACTS and its licensors own all rights in their respective software, source and object code, interfaces,

workflows, graphics, illustrations, animations, text, documentation, product names, logos, trade dress, domains, databases, and other original materials used in the Company Services ("ARTIFACTS Materials"). ARTIFACTS Materials are protected by copyright, trademark, design, trade-secret, contract, and other laws.


This ownership does not include:


- content that a user owns and submits;

- third-party book data, images, marks, or services;

- open-source components governed by their own licences; or

- public-domain material.


You may not remove proprietary notices or use ARTIFACTS trademarks in a company name, product name,

domain, social handle, advertising keyword, or branding without prior written permission, except for accurate

nominative reference permitted by law.


8. Your content


You retain ownership of text, images, files, feedback messages, and other material you submit ("Your Content").

You represent that you have the rights and permissions needed to submit and use Your Content.


You grant ARTIFACTS a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, display, modify, and process Your Content only as reasonably necessary to provide, secure, support, and improve the feature you requested, comply with law, and enforce these Terms. This operational licence ends when Your Content is deleted from active systems, subject to lawful retention and backup cycles.


We do not acquire ownership of Your Content merely because you use an ARTIFACTS product.


9. Feedback and suggestions


If you voluntarily send an idea, feature request, design suggestion, or other feedback, you allow ARTIFACTS to use it without restriction or payment. This prevents a later claim that ordinary product development based on general feedback infringes your rights. The licence does not authorise us to publish your private personal data or confidential material contrary to our Privacy Policy.


10. Third-party and open-source materials


Company Services may contain or connect to app stores, cloud providers, open-source software, APIs, content catalogues, payment services, or other third-party services. Third-party terms and privacy policies govern those services. ARTIFACTS does not own third-party marks or content and does not promise that every third-party service will remain available.


Open-source software included in a product remains governed by its applicable open-source licence. If an

open-source licence conflicts with these Terms for that component, the open-source licence controls.


11. Purchases, subscriptions, and taxes


If a product offers a purchase or subscription, the price, billing period, renewal terms, trial, included features, and material limitations will be shown before purchase. Digital purchases made through Apple, Google, Microsoft, or another marketplace are processed by that marketplace. A future web or software-as-a-service purchase may instead be processed by a payment provider identified at checkout, such as Stripe. ARTIFACTS generally does not receive your full card, bank, or payment-instrument details.


Auto-renewing subscriptions renew until cancelled through the marketplace or billing provider. Deleting an app or ARTIFACTS account does not automatically cancel a marketplace subscription. Refunds, chargebacks, billing recovery, taxes collected at checkout, and subscription management are subject to the marketplace's rules and mandatory law.


ARTIFACTS may change prices for future purchases. Existing subscriptions will receive notice, consent, or

cancellation rights as required by the marketplace and applicable law. We will not use hidden charges, pre-checked purchases, or misleading trial language.


12. Betas, previews, and experimental features


A beta, preview, prototype, early-access feature, or experimental service may be incomplete, change rapidly,

contain errors, or be discontinued. We will identify it where reasonably possible. Do not rely on a beta for safety-critical, legal, financial, medical, or irreplaceable work. Confidential preview terms may apply if separately agreed.


13. Changes, updates, and discontinuation


We may add, remove, redesign, limit, or update Company Services to improve them, address security, comply with law or platform rules, respond to third-party changes, or keep operations sustainable.

We may suspend or discontinue a product or feature. When a planned discontinuation materially affects stored user content or an active paid term, we will, where reasonably possible:


- give advance notice through the product, website, or account email;

- maintain access through the current paid period or provide an appropriate remedy required by law or the payment platform; and

- provide a reasonable opportunity to export user-provided content in a commonly usable format.


Immediate action may be necessary for security, abuse, illegality, force majeure, provider failure, or other urgent circumstances. Nothing in this section limits mandatory refund, warranty, or consumer rights.


14. Privacy


Our Company Privacy Policy explains company-level data practices. Product-specific privacy policies provide additional details. A privacy notice is not a transfer of ownership and is not a request for blanket consent. Where consent is required, we request it in context.


15. Availability and communications


We aim to keep Company Services reliable, but continuous or error-free access is not guaranteed. Maintenance, network conditions, app-store review, device compatibility, third-party outages, security incidents, or force majeure may affect availability.


Electronic notices may be delivered through the website, a product, an app-store listing, or the email associated with your account. You are responsible for keeping a working contact address where an account requires one.


16. Copyright and intellectual-property complaints


If you believe content made available by ARTIFACTS infringes your rights, email contact@artifacts.software with:

- your name and contact details;

- identification of the protected work or right;

- the exact location of the material;

- a good-faith explanation of the alleged infringement;

- a statement that the information is accurate and you are the rights holder or authorised to act; and

- your physical or electronic signature.

We may remove or restrict material while investigating and may request more information. Knowingly false notices may create liability.


17. Disclaimers and consumer guarantees


We will provide Company Services with reasonable care and skill. Except for express promises and rights that cannot lawfully be excluded, Company Services are provided on an "as available" basis. We do not promise that every feature will meet every individual need, be uninterrupted, or be free from all errors or security risks.


Website and product descriptions are general information, not medical, legal, financial, tax, or other professional advice. Third-party information may be inaccurate or change without notice.


Nothing in these Terms excludes a statutory guarantee, warranty, remedy, or consumer right that cannot lawfully be excluded or limited.


18. Limitation of liability


To the maximum extent permitted by law, ARTIFACTS is not liable for indirect, incidental, special, exemplary, or consequential loss, or for lost profits, lost opportunities, or lost data, arising from use of a free Company Service where the loss was not reasonably foreseeable or was caused by circumstances outside our reasonable control.


For claims that may lawfully be limited, ARTIFACTS' aggregate liability relating to a Company Service will not

exceed the greater of:


- the amount you paid ARTIFACTS for that Company Service during the 12 months before the event giving rise to the claim; or

- INR 5,000.


This limitation does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of confidentiality or data-protection obligations where liability cannot be limited, infringement for which ARTIFACTS is legally responsible, or any non-excludable consumer remedy.


19. Your responsibility for misuse


To the extent permitted by law, you are responsible for reasonably foreseeable loss caused by your intentional

unlawful use, infringement, fraud, malicious conduct, or material breach of these Terms. You are not responsible for losses caused by ARTIFACTS, another user, or a vulnerability you did not create.


20. Suspension and termination


You may stop using a Company Service at any time and may request account deletion where available.


We may restrict or terminate access if reasonably necessary to address a material breach, non-payment, fraud, abuse, a security threat, illegality, platform requirement, or discontinuation. Except where urgent action is necessary, we will try to provide notice and a reasonable opportunity to cure a remediable breach.


On termination, the use licence ends. Provisions that by their nature should survive - including ownership, payment obligations, disclaimers, liability limits, dispute terms, and lawful retention - remain effective.


21. Governing law and dispute resolution


These Terms are governed by the laws of India, without excluding mandatory protections of the country or state where you reside.


Before filing a formal claim, you and ARTIFACTS agree to attempt in good faith to resolve it by written notice for at least 30 days. Send a notice to contact@artifacts.software with the subject "Legal Dispute" and a concise description of the issue and requested resolution.


If the dispute is not resolved, courts with jurisdiction in Bengaluru, Karnataka, India will have non-exclusive

jurisdiction, except that you may bring a claim in another forum where mandatory consumer law permits. These Terms do not require private arbitration and do not waive a lawful right to participate in a collective proceeding.


22. Changes to these Terms


We may update these Terms for new features, clearer wording, security, legal, platform, or operational reasons. We will post the revision and update the date. If a change materially disadvantages existing users, we will provide reasonable advance notice where practicable and obtain acceptance where required. Changes do not retroactively rewrite completed transactions.


23. General terms


If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent, but we may transfer it as part of a merger, reorganisation, or sale while preserving applicable rights. These Terms, applicable product terms, and any written order or contract form the entire agreement for their subject matter.
